And this SEC filing is worth reading. Everyone got scammed by Samberg. The CFO tried to fight it and couldn't. I'm sure the CTO and CLO did as well. Sanberg told the CEO he hoped he would die.

And Sanberg kept lying and lying. He scammed everyone in the company. Controlled the board, to the point of paying someone 12.3m and putting him on the board , so he could cover up everything.

He Wouldn't let anyone, including the executives, see his round trip LOIs that were a complete fraud and he invented a metric, EBITDAM. That was EBITDA plus marketing expenses to try to show a profit. Which was laughable.

Nothing in the company was real except the hopes and dreams of the people who worked there because they believed in the cause, and the hopes by investors that Sanberg would deliver on his promises that none of them knew were fraudulent

All of this is public knowledge.

But the one thing you don't have is anything between Sanberg and the clippers showing collusion.

Like with Madoff , everyone working there thought things were great.

Until the indictments came in.

The folks Pablo has talked to are as much victims as Ballmer is in this. If they had any idea they would have turned him into the feds, which would of course stopped ballmer from investing.

  4. Mark, you **just** tried to use a statement from Sanberg as evidence that Balmer wasn’t responsible for the Kawhi payments.

  5. They don’t need to prove it though. I don’t know why people are so caught up with that part. The NBA doesn’t require indisputable evidence to act. They just need to be convinced of it. And the evidence is more than convincing enough imo.

    Yes, the company was run by crooks who did shady things to enrich themselves…but they also decided to prioritize paying Kawhi for doing absolutely nothing. How does this make sense as anything else other than to skirt the cap?

  9. This basically makes it clear that Cuban is waiting for Pablo to come up with a tape of Ballmer maniacally laughing and explaining the entire plot to the audience. That’s not the standard in any court room, let alone an NBA investigation.

  14. Exactly. For what other reason would he have worked the Kawhi shady deal in such secrecy except upon request by Ballmer because they knew what they were doing

  19. Wait, am I getting this right: so Mark *just* quoted Samberg, Pablo denounces him, then Mark writes a whole long thing pretty much agreeing? Even though Mark’s “gotcha” was a quote by Samberg in the first place?

    Also, I feel like the last line is a fucking Scooby Doo moment of “Okay you got me, but you’re missing the one thing to prove I was the killer!” Bad look.
