Why not publish the docs you have? The emails from Sanberg? You showed us some docs. Why not show the ones you reference? That we have to take your word on ? Particularly since other media said they had seen internal docs as well none have come out with anything relevant to the CBA since your reporting.

And did you ask you internal sources if they said anything to KPMG before they resigned because of suspected revenue fraud ? Or the internal committee they put together to investigate the fraud but apparently, shockingly, found nothing ?

If the ballmer 50/12 was directed to KL, as your sources said, why was he only paid 3.5m and then not paid again till after the next raise in Dec 22 ? And never got his last 7.

And btw, they actually paid 29m in carbon credits for the World Cup. One of your execs asked for cash escrow. Sanberg got an email from the other side, and Sanberg overruled the exec and did no cash escrow. Crazily enough, the company got sued and the judge ruled they should get the 29m back

TL;DR:

Mark Cuban basically argues that if there were any real “smoking gun” evidence, it would’ve been published already, but the reporting keeps pointing to documents and emails (like from Sanberg) without actually showing them. He points out that other media outlets with access to internal docs haven’t found anything to back the story either.

Cuban also leans on the fact that KPMG, the outside auditors, and the company’s own internal fraud committee both looked into suspected revenue fraud and came up empty. On top of that, the supposed $50M/12 payment tied to Kawhi doesn’t line up with the actual numbers, since Kawhi only got $3.5M and never received the rest. Cuban says the reporting even got it wrong by implying the $50M was linked to Kawhi’s “28.”

To him, the real takeaway is that Sanberg was the one controlling everything, as shown by a separate $29M carbon credits deal where Sanberg overruled his own execs and a judge later ordered the money repaid. Just like he did with the Kawhi deal according to the BSJ report and Pablo’s repackaging of that same report as his own this past weekend. His bottom line is that Sanberg ran the show, not Ballmer or Kawhi, and even if that $29.5M judgment was collected, none of it ever went to Kawhi.

    This burden of proof is not necessary for the league and he knows that. Yet he continues to frame things as if this weren’t true at all. Adam Silver said it himself, “a smoking gun is circumstantial evidence”.

    I’m not sure why we continue to share Cuban posts at this stage of Pablo’s reporting. At least not without a reply from Pablo. That’s where the entertainment is at.

  24. There are clearly things about the Kawhi/Aspiration deal that we don’t understand, but that doesn’t make the deal unlikely or exonerating — it’s just a blank in the story.

    The things we don’t understand about the Ballmer/Aspiration deal are logical inconsistencies that, unless there’s a damn good explanation, would mean that the Clippers group are up to something no good.

    That’s the difference. Cuban can go on all day about “Ah how come the scheduled payment was late here but not here and blah blah blah” but what matters is what blanks are incriminating and what blanks are just parts of a story.

    It’s not possible to produce a 1:1 smoking gun. This is a business with thousands of transactions. They’re drawing from a well of funds.

    If you’ve ever run or led a business’ P&L, you’d know expenses aren’t always mapped for their intended purpose, unless they’re paid to specific vendors for specific scopes of work.

    What does Mark want – a complete paper trail where Clips are paying Invoice #01 to Aspiration amounting $X and Kawhi billing $X to Aspiration at the exact same cadence?

    The point was to avoid a paper trail. They clearly made mistakes here and there, hence PTFO, but you’ll still have to join the dots yourself. Wtf.

    The chain of “custody” of those Ballmer-Kawhi funds broke down when Aspiration didn’t pace their cash right, and it caused them to ask for top-ups from Ballmer and Wong sporadically.

    Dude is defending Ballmer and stretching out plausible deniability to its parameters.
