Fuck scummy defense lawyers
Not a lawyer, but my understanding is “should I have a lawyer?” is not the same as “I want a lawyer/desire representation.” Also making spontaneous remarks is admissible. Time for this bozo to plead guilty and give Gaudreaus some peace and justice.
Judge got this one wrong. Should have split the difference and allowed the roadside testimony but excluded statements made after he requested a lawyer. I hate how cops pressure people into making statements without an attorney present, and they’re supposed to stop the interview once someone has requested an attorney.
I strongly disagree that “I think I need to talk to a lawyer,” isn’t clear enough of a request for a lawyer. The intention behind that statement is clear. To hold otherwise encourages bad behavior by cops.
