(WGHP) — A Davidson County woman was awarded a little over $850,000 in a lawsuit against former NASCAR Truck Series driver Jennifer Jo Cobb, according to court records.

The trial for the alienation of affection lawsuit lasted three days.

Court records show that a jury found that Cobb caused alienation in the marriage between Tracey M. Hughes and her husband, Clayton Odie Hughes, and that Tracey was entitled to $50,000 in recovery funds from Cobb.

The jury also decided that Tracey was entitled to $800,000 from Cobb for criminal conversation.

Criminal conversion happens when a third party has sexual intercourse with a married person. Despite the name, criminal conversion is a claim in a civil lawsuit for monetary damages, and no jail time is involved.

To win a criminal conversion claim, the plaintiff must prove that they and their spouse were legally married and that the defendant had sexual intercourse with the plaintiff’s spouse while the plaintiff and their spouse were legally married.

The jury also awarded Tracey $1 in punitive damages for alienation of affection and $1 in punitive damages for criminal conversion, bringing the total amount to $850,002.

Background

Tracey and Clayton were married on Sept. 4, 2003, and separated on Jan. 20, 2021, according to the lawsuit.

The lawsuit states that for multiple months up to and including Jan. 20, 2021, Cobb knew Tracey and Clayton were married and “willfully, intentionally, and deliberately seduced, enticed, and alienated the affections of” Tracey from Clayton.

Cobb encouraged Clayton to lie about what he did on trips and set up regular meetings to engage in illicit sexual activity, according to the lawsuit.

“The conduct alleged … occurred in several locations including phone calls of a sexual nature, text messages and sexual liasons in North Carolina and in other states while traveling for racing competitions,” the lawsuit states.

The lawsuit claims Tracey sought $25,000 in damages because Cobb deprived her “of the comfort, society, aid and services of her husband, and has destroyed Plaintiff’s home and happiness forever.”
