Charges have been dropped against two Warwick men stemming from a deadly fight in the stands during a New England Patriots game.
Foxborough police charged John Vieira, 59, and Justin Mitchell, 39, with assault and battery and disorderly conduct.
Dale Mooney, 53, of Newmarket, New Hampshire died shortly after the fight in September 2023. Police said he started the fight.
According to court documents, police obtained video footage that showed Mitchell, Vieira, Mooney, and another man engaging in a struggle.
Police said Vieira was seen punching Mooney in the area of the head.
Mooney appeared to be punched in the face one or two times before he threw Mitchell across his body and over the seats below, according to court documents.
At some point, Mooney loses consciousness, according to the document. He was later pronounced dead at Sturdy Memorial Hospital in Attleboro.
The district attorney said Mooney’s cause of death was a medical issue, an irregular heartbeat in a person with a heart condition during a physical altercation, and not trauma.
