The state’s highest court on Thursday, Oct. 16, denied a motion by a University of Oregon football player alleging prosecutorial misconduct in front of a grand jury.
Daylen Austin, 20, previously had a trial date of Aug. 14 before he filed the motion to the Oregon Supreme Court. A stay was granted pending review of Austin’s motion, meaning the trial was delayed.
In December, a new trial date of Feb. 2, 2027, was set for Austin. His next court hearing is scheduled for Jan. 29 of next year.
Austin has been charged with failing to perform the duties of a driver to an injured person. A grand jury indicted Austin in connection with the death of a pedestrian struck by a vehicle he was driving. The collision took place in April 2024, at West Fourth Avenue and Polk Street in Eugene.
Austin had asked the Oregon Supreme Court to reverse a previous denial of a motion he made in Lane County Circuit Court seeking dismissal of the charge.
The order issued Oct. 16 said only, “Upon consideration by the court. The petition for writ of mandamus is denied.”
Austin is a defensive back on the Ducks football team.
He has played in multiple games this season, including the recent Orange Bowl win against Texas Tech, but a day after that game a report by On3 said he is entering the transfer portal.
