CLEVELAND <\/a>(WJW) \u2013 The FOX 8 I-Team<\/a> has found attorneys for the\u00a0city of Cleveland and for the Cleveland Browns<\/a> are asking a judge to allow the team to keep building a new enclosed stadium in Brook Park.<\/p>\n

The Browns and the city of Cleveland just teamed up to fight back against a lawsuit filed by former mayor Dennis Kucinich, filing new arguments saying work is already underway at the sight of a new Browns stadium.<\/p>\n

Last month, Kucinich asked for a preliminary injunction to stop the Browns from doing anything further.\u00a0Kucinich wants all work on the dome stopped, and his lawsuit aims at forcing the team to stay on the lakefront.<\/p>\n

But lawyers for the Browns and for the city of Cleveland both just asked a judge to allow work on the dome project to keep going.<\/p>\n

The motion from an attorney representing the Browns states to stop the project\u00a0now would \u201ccause harm not only to the Browns, but to its partners in the new stadium project, including Brook Park, and the Ohio citizens that the General Assembly determined would benefit from the Brook Park stadium project.\u201d<\/p>\n

The new filings also point out the city of Cleveland and the Browns have already reached a settlement on legal fights over the team moving and argue the former mayor is trying to fight a legal battle that\u2019s already over.<\/p>\n

\u201cThe city council specifically approved the parties\u2019 settlement,\u201d the motion from an attorney representing the city of Cleveland states.\u00a0\u201cIn return for the historic $100 million in funds from the Browns to bolster the Cleveland community, the city agreed to dismiss its prior claims.\u201d<\/p>\n

In two weeks, a judge is expected to hold a hearing on the preliminary injunction motion.<\/p>\n
