{"id":751040,"date":"2026-02-14T07:07:16","date_gmt":"2026-02-14T07:07:16","guid":{"rendered":"https:\/\/www.rawchili.com\/nfl\/751040\/"},"modified":"2026-02-14T07:07:16","modified_gmt":"2026-02-14T07:07:16","slug":"brian-flores-discrimination-lawsuit-against-nfl-can-proceed-in-open-court-sdny-rules","status":"publish","type":"post","link":"https:\/\/www.rawchili.com\/nfl\/751040\/","title":{"rendered":"Brian Flores\u2019 discrimination lawsuit against NFL can proceed in open court, SDNY rules"},"content":{"rendered":"<p class=\"mb-4 text-lg md:leading-8 break-words\">NEW YORK \u2014 All of the claims in Brian Flores\u2019 racial discrimination lawsuit against the NFL and multiple teams, including the Giants, can proceed in court, a federal judge in Manhattan ruled Friday.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In a 14-page order, Manhattan Federal Court Judge Valerie Caproni ruled that Flores and other coaches suing the NFL can pursue their claims before her instead of the closed-door arbitration process sought by the league.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Caproni had previously sent certain claims made by Flores and fellow coaches Steve Wilks and Ray Horton to arbitration, but the 2nd Circuit Court of Appeals reversed that order in August.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The appellate court found that the NFL had failed to provide a neutral forum that could fairly be described as \u201carbitration,\u201d and that Flores could not effectively vindicate his rights given the designation of NFL Commissioner Roger Goodell as the default arbitrator.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Denying the NFL\u2019s motion to compel arbitration in full, Caproni on Friday rejected the league\u2019s insistence that procedural safeguards installed after the appeals court ruling warranted a different outcome, finding the guidelines\u2019 role \u201cmuddled at best\u201d and not a fix for the forum\u2019s lack of independence.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThis case, even as it has progressed very little, illustrates the failures of the NFL to provide a process that constitutes \u2018arbitration\u2019 as that term is used by the [the Federal Arbitration Act],\u201d the judge wrote.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThe NFL\u2019s unilateral control over the dispute resolution process is the fatal flaw.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Lawyers for the NFL did not immediately respond to a request for comment.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In a statement, the coaches\u2019 attorneys welcomed the ruling.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThe court\u2019s decision recognizes that an arbitration forum in which the defendant\u2019s own chief executive gets to decide the case would strip employees of their rights under the law,\u201d attorneys Douglas H. Wigdor and David E. Gottlieb said.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cIt is long overdue for the NFL to recognize this and finally provide a fair, neutral and transparent forum for these issues to be addressed.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Flores, who is Black, sued the NFL, Giants, Denver Broncos and Houston Texans in early 2022, claiming the league was \u201crife with racism\u201d as he interviewed for head coaching jobs after he was fired by the Miami Dolphins.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The Brooklyn-born Flores alleged those teams spoke to him only to satisfy the NFL\u2019s \u201cRooney Rule,\u201d which requires teams to interview at least two minority candidates before filling certain positions.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">During that cycle, the Giants hired Brian Daboll as head coach. They denied the accusation made by Flores, who has been the Minnesota Vikings\u2019 defensive coordinator since 2023.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Wilks, whose allegations are against the Arizona Cardinals, and Horton, whose claims are against the Tennessee Titans, joined Flores\u2019 lawsuit in April 2022.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Earlier this month, Goodell voiced support for the Rooney Rule but said the NFL must continue to evaluate everything. Those comments came after only one of the NFL\u2019s 10 head coach openings went to a minority coach \u2014 the Titans\u2019 Robert Saleh \u2014 this offseason.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cI think we have become a more diverse league across every platform, including coaching, but we still have more work to do,\u201d Goodell said at a press conference ahead of the Super Bowl.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThere\u2019s got to be more steps. We\u2019re reevaluating everything we\u2019re doing, including our accelerator program and including every aspect of our policies in our programs to meet the challenges of today and tomorrow rather than yesterday.
