{"id":868267,"date":"2026-04-17T09:33:22","date_gmt":"2026-04-17T09:33:22","guid":{"rendered":"https:\/\/www.rawchili.com\/nfl\/868267\/"},"modified":"2026-04-17T09:33:22","modified_gmt":"2026-04-17T09:33:22","slug":"ex-alabama-player-faces-identity-theft-charge-for-michael-penix-impersonation-report","status":"publish","type":"post","link":"https:\/\/www.rawchili.com\/nfl\/868267\/","title":{"rendered":"Ex-Alabama Player Faces Identity Theft Charge for Michael Penix Impersonation: Report"},"content":{"rendered":"<p id=\"inline-text-1\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"6l\"><a href=\"https:\/\/www.si.com\/nfl\/falcons\/onsi\" rel=\"nofollow noopener\" target=\"_blank\">Atlanta Falcons<\/a> quarterback Michael Penix Jr. may have been the victim of identity theft.<\/p>\n<p id=\"inline-text-2\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"6o\">According to federal court records, former Alabama player Luther Davis faces charges of wire fraud and identify theft for impersonating Penix and other NFL players from May 2023 to October 2024 to try and secure almost $20 million in loans.<\/p>\n<p id=\"inline-text-3\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"6r\">ESPN&#8217;s Michael Rothstein <a href=\"https:\/\/www.espn.com\/nfl\/story\/_\/id\/48504890\/report-penix-njoku-mckinney-targets-ex-bama-de-fraud\" rel=\"nofollow noopener\" target=\"_blank\">wrote<\/a> Thursday that Davis allegedly wore wigs and used fake drivers licenses to pretend to be Penix along with two other prominent NFL players &#8212; Cleveland Browns tight end David Njoku and Green Bay Packers safety Xavier McKinney.<\/p>\n<p id=\"inline-text-4\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"6u\">Like Davis, McKinney played college football at Alabama. The safety was a second-round pick for the New York Giants in 2020.<\/p>\n<p id=\"inline-text-5\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"6x\">But Penix and Njoku were first-round picks from the Pac-12 and ACC. Penix played in the Big Ten as well but never in the SEC.<\/p>\n<p id=\"inline-text-6\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"70\">&#8220;The court documents state that none of the players had authorized the loans and that fake email accounts were created without their knowledge,&#8221; wrote Rothstein.<\/p>\n<p>Who Is Alabama&#8217;s Luther Davis?<\/p>\n<p id=\"inline-text-8\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"76\">Davis played at Alabama in the early Nick Saban era. According to Rivals.com, he was one of the best defensive tackle recruits of the 2007 class.<\/p>\n<p id=\"inline-text-9\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"79\">A Louisiana native, Davis was expected to attend LSU. But he de-committed from the Tigers to play for Saban in Tuscaloosa.<\/p>\n<p id=\"inline-text-10\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"7c\">Davis played at Alabama from 2007-10. He appeared in all 14 games during the 2009 season, which was Saban&#8217;s first national championship with the Crimson Tide.<\/p>\n<p id=\"inline-text-11\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"7f\">In 45 college games, Davis posted eight tackles for loss with zero sacks. He also had one pass defense.<\/p>\n<p id=\"inline-text-12\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"7i\">In 2013, <a href=\"https:\/\/www.al.com\/alabamafootball\/2013\/09\/who_is_luther_davis_former_ala.html\" rel=\"nofollow noopener\" target=\"_blank\">AL.com&#8217;s Andrew Gribble called<\/a> the former defensive lineman a &#8220;steady, reliable contributor.&#8221; But he went unselected in the 2011 NFL Draft.<\/p>\n<p id=\"inline-text-13\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"7l\">In Sept. 2013, <a href=\"https:\/\/sports.yahoo.com\/ncaaf--documents--texts-reveal-impermissible-benefits-to-five-sec-players-202513237.html\" rel=\"nofollow noopener\" target=\"_blank\">Yahoo Sports implicated<\/a> Davis for a role where he alledgely provided improper benefits to five SEC football players. One of those five players included Crimson Tide teammate D.J. Fluker.<\/p>\n<p>The Latest Acquisitions Against Luther Davis<\/p>\n<p id=\"inline-text-15\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"7r\">Rothstein wrote Thursday that Davis and his partner, CJ Evins, alledgely used three identities &#8212; D.N., X.M. and M.P. &#8212; to apply for loans. Obviously, those are the initials of the three NFL players &#8212; Njoku, McKinnley and Penix.<\/p>\n<p id=\"inline-text-16\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"7u\">The report stated Davis and Evins went to great lengths to impersonate the Falcons quarterback and the other two players.<\/p>\n<p id=\"inline-text-17\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"7x\">&#8220;To convince lenders they were the three players, the court documents allege that Davis and Evins created &#8216;fabricated personal financial statements, Secretary of State documents, and bank statements for companies purportedly operated by the players,'&#8221; add Rothstein. &#8220;The document, filed March 19 in Atlanta, alleges that Davis and Evins registered companies similar to the names of the players to accomplish this.&#8221;<\/p>\n<p id=\"inline-text-18\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"80\">Overall, Davis applied for 13 fake loans for more than $19.8 million.<\/p>\n<p id=\"inline-text-19\" class=\"my-[18px] [&amp;_a]:text-secondary my-f-1.5\" q:key=\"0\" q:id=\"83\">Plea hearings for Davis and Evins will occur on April 27.
