(Ashley Landis\/The Dallas Morning News)<\/p>\n<p>Staff Photographer<\/p>\n<p>Former Cowboys QB <a href=\"https:\/\/www.dallasnews.com\/sports\/cowboys\/article\/tony-romo-arrest-22359290.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Tony Romo<\/a> will face civil penalties for four citations after he was arrested on suspicion of operating a vehicle while intoxicated in Wisconsin last week.\u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/cdn-channels-pixel.ex.co\/events\/0012000001fxZm9AAE?integrationType=DEFAULT&amp;template=design%2Farticle%2Fplatypus_two_column.tpl\" alt=\"\" class=\"x1px y1px vh abs\" aria-hidden=\"true\" width=\"1\" height=\"1\"\/><\/p>\n<p>After he was arrested, Romo faced three citations for operating under the influence, unsafe passing on the right, and allegedly possessing an open bottle of an alcoholic beverage in his car, according to documents from the <a href=\"https:\/\/www.scribd.com\/document\/1067768860\/Romo-Citations#from_embed\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Wisconsin Department of Transportation<\/a>.\u00a0<\/p>\n<p>Romo was hit with a <a href=\"https:\/\/www.dallasnews.com\/sports\/cowboys\/article\/ex-cowboys-qb-tony-romo-issued-citation-following-22363531.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">fourth citation<\/a> on Monday for refusing to take a second breathalyzer test after he was arrested \u2014 an issue Wisconsin defense attorneys who spoke with The Dallas Morning News flagged as potentially more serious.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>Watch: <a href=\"https:\/\/www.dallasnews.com\/sports\/cowboys\/article\/tony-romo-arrest-video-sobriety-test-22365406.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Key moments from Tony Romo&#8217;s Wisconsin arrest video<\/a><\/p>\n<p>\u201cThe refusal carries harsher penalties than the drunk driving,\u201d said Tony Cotton, a Wisconsin defense attorney not involved in Romo\u2019s case.\u00a0<\/p>\n<p>The CBS Sports NFL analyst was arrested in Milwaukee July 23 after an arresting officer found he performed \u201cpoorly\u201d on a standard field sobriety test. He was visiting Wisconsin to compete in the Wisconsin Amateur Championship.<\/p>\n<p>Julius Kim, a defense attorney listed as representing Romo in the case, did not immediately respond Wednesday to multiple phone call requests for comment on the citations.\u00a0<\/p>\n<p>Body camera footage released Tuesday night shows Romo refusing to take an initial breathalyzer test, saying he \u201cheard from all the lawyers, don\u2019t ever do that.\u201d Taylor Hart, a criminal defense lawyer in Wisconsin not associated with the case, said Romo was within his rights to decline the initial test \u2014 and that he won\u2019t face any consequences for doing so.\u00a0<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>\u201cI also advise my clients to decline the preliminary breathalyzer test,\u201d Hart said.\u00a0<\/p>\n<p>Related: <a href=\"https:\/\/www.dallasnews.com\/sports\/cowboys\/article\/ex-cowboys-qb-tony-romo-issued-citation-following-22363531.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Ex-Cowboys QB Tony Romo issued citation following Wisconsin arrest<\/a><\/p>\n<p>The footage also shows Romo asking to speak with an attorney before submitting to sobriety tests \u2014 requests that the arresting officer repeatedly denied. Milwaukee-based trial attorney Claude-Allan Mihomme said the officer was within her right to deny Romo\u2019s request, since the right to an attorney doesn\u2019t kick in until after an individual is placed in custody.\u00a0<\/p>\n<p>Attorneys said Romo\u2019s decision to refuse a second breathalyzer test after he was arrested could get him into hot water, since he was required to take the test under Wisconsin state law. \u00a0<\/p>\n<p>\u201cIt\u2019s a bad idea to refuse,\u201d Cotton said.\u00a0<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>Just like Texas, Wisconsin is an \u201cimplied consent\u201d state \u2014 by getting on the road, drivers indirectly agree that they\u2019ll submit to certain testing if officers believe they are driving under the influence. By refusing the second test, Hart said Romo triggered legal liability and the subsequent refusal citation.\u00a0<\/p>\n<p>The citation carries a more severe punishment than the OWI charge, according to Milhomme.
