The Crown suffered a major blow when a text boasting of Dillon Dub\u00e9 touching the complainant was dismissed on the grounds of inability to verify the claim. This decision is consistent with the court’s insistence on greater scrutiny of informal communications in serious criminal matters, especially when such informal communications are put forth as the capstone evidence in a trial of this magnitude.<\/p>\n

On Monday, Justice Carroccia issued an order that dealt a second blow to the Crown’s efforts in admitting the crucial piece of text evidence in the Hockey Canada trial. The message was sent by Brett Howden to Taylor Raddysh sometime in June 2018 and referenced Dillon Dub\u00e9 allegedly smacking the complainant’s buttocks. The judge, however, deemed the statement inadmissible as hearsay because she was concerned about the truth of the finding and the circumstances of its being sent.Howden, a Crown witness, had earlier admitted sending a message during the period an internal inquiry was launched at Hockey Canada. It is said that Howden wrote the message while being “scared” and “nervous,” and it was never sworn or preserved in a statement of formal record. Carroccia challenged the veracity of the message by stating that Howden was not within the realm of literal accuracy. This is the second failed attempt the prosecution has made to tender this text as evidence. They had earlier attempted to admit it under \u201cpast recollection recorded\u201d but were unsuccessful. The text had claimed Dub\u00e9 was slapping the complainant with some force, described as painful, with further harrowing allegations surfacing against McLeod, Hart, Formenton, and Foote. According to the Crown, E.M. was the recipient of a series of non-consensual acts by these players in a hotel room in London.Howden testified that he no longer recalled the facts of the incident but that he believed he was telling the truth when writing the message. The cross-examination of Howden by the accused players’ defense teams continued on Monday.
