{"id":490315,"date":"2026-03-07T02:30:19","date_gmt":"2026-03-07T02:30:19","guid":{"rendered":"https:\/\/www.rawchili.com\/nhl\/490315\/"},"modified":"2026-03-07T02:30:19","modified_gmt":"2026-03-07T02:30:19","slug":"stars-mavericks-trade-blows-in-court-over-dueling-lawsuits","status":"publish","type":"post","link":"https:\/\/www.rawchili.com\/nhl\/490315\/","title":{"rendered":"Stars, Mavericks trade blows in court over dueling lawsuits"},"content":{"rendered":"<p class=\"body-text-paragraph\">For 20 months, <a href=\"https:\/\/www.dallasnews.com\/sports\/stars\/2026\/01\/21\/dallas-stars-mavericks-legal-suit-hearings-trial-american-airlines-center\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.dallasnews.com\/sports\/stars\/2026\/01\/21\/dallas-stars-mavericks-legal-suit-hearings-trial-american-airlines-center\/\">the Mavericks and Stars\u2019 discord<\/a> largely has been behind the scenes, other than bubbling forth last October in filings of dueling lawsuits.<\/p>\n<p class=\"body-text-paragraph\">That made Friday afternoon\u2019s summary judgment hearing the first public glimpse of bad blood between Dallas\u2019 NBA and NHL franchises, with their respective attorneys trading verbal blows for a little more than two hours in Texas Business Court.<\/p>\n<p class=\"body-text-paragraph\">The scene was the Walsh classroom of SMU\u2019s Dedman School of Law. Location and point of operations is a central theme of why these teams find themselves here, jousting not on a field of play, but in a makeshift courtroom.<\/p>\n<p class=\"body-text-paragraph\">In attendance Friday were several dozen SMU law students and faculty; a handful of reporters and both franchises\u2019 expansive legal teams, including Mavericks general counsel and chief ethics officer Sekou Lewis; and Stars president and CEO Brad Alberts.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" style=\"aspect-ratio:3500 \/ 2334\"   class=\"dmnc_images-modern-image-module__QFaG- max-w-full h-auto text-white dmnc_images-modern-image-module__9Zlll bg-gray-light object-contain\" width=\"3500\" height=\"2334\" src=\"https:\/\/www.rawchili.com\/nhl\/wp-content\/uploads\/2026\/03\/4IYRKIJ5IZFLNCRZPNQKEEY7FY.jpg\" alt=\"Sekou Lewis, the Dallas Mavericks general counsel and chief ethics officer, center, is seen...\"\/><\/p>\n<p>Sekou Lewis, the Dallas Mavericks general counsel and chief ethics officer, center, is seen during a hearing concerning the Dallas Mavericks and the Dallas Stars lawsuit over control of American Airlines Center in the Texas Business Court at Karcher Hall on the SMU campus, Friday, March 6, 2026, in University Park. <\/p>\n<p>Chitose Suzuki \/ Staff Photographer<\/p>\n<p class=\"body-text-paragraph\">It had been four months and nine days since the Mavericks, last Oct. 28, filed a 253-page petition against the Stars.<\/p>\n<p class=\"body-text-paragraph\">The petition seeks injunctive relief and finality on a breach of contract dispute <a href=\"https:\/\/www.dallasnews.com\/sports\/mavericks\/2025\/10\/28\/mavericks-stars-arena-legal-ruling-aac\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.dallasnews.com\/sports\/mavericks\/2025\/10\/28\/mavericks-stars-arena-legal-ruling-aac\/\">the Mavericks raised in October 2024<\/a>.<\/p>\n<p class=\"body-text-paragraph\">The Mavericks allege the Stars breached a clause in both teams\u2019 1998 franchise agreement with the City of Dallas, before American Airlines Center\u2019s 2001 opening. The clause requires the teams\u2019 corporate headquarters to be within Dallas city limits.<\/p>\n<p class=\"body-text-paragraph\">The Stars have had their headquarters and training facility in Frisco since 2003. In October 2024, the Mavericks alleged the breach and claimed control of Center Operating Company \u2014 which operates AAC \u2014 and ever since have held both teams\u2019 arena revenues in escrow.<\/p>\n<p class=\"body-text-paragraph\">Naturally both franchises hired high-powered law firms \u2014 <a href=\"https:\/\/www.dallasnews.com\/sports\/stars\/2026\/02\/19\/dallas-stars-mavericks-lawsuit-trial-attorney-lawyer-joshua-sandler\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.dallasnews.com\/sports\/stars\/2026\/02\/19\/dallas-stars-mavericks-lawsuit-trial-attorney-lawyer-joshua-sandler\/\">Winstead for the Stars<\/a>, and for the Mavericks, Jackson Walker. Mavericks lead attorney Chip Babcock has litigated for the likes of <a href=\"https:\/\/www.dallasnews.com\/sports\/mavericks\/2026\/02\/19\/dallas-mavericks-stars-lawsuit-chip-babcock-oprah-american-airlines-center\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.dallasnews.com\/sports\/mavericks\/2026\/02\/19\/dallas-mavericks-stars-lawsuit-chip-babcock-oprah-american-airlines-center\/\">Oprah Winfrey, Dr. Phil, Jerry Jones and Mark Cuban<\/a>.<\/p>\n<p class=\"body-text-paragraph\">\u201cOprah always asks me when we\u2019re in litigation, \u2018Why are we here?\u2019 Babcock said. \u201cAnd that\u2019s a good question for this case. And why we\u2019re here may shed some light on where we go from here. But there were two events that triggered this.\u201d<\/p>\n<p class=\"body-text-paragraph\">Babcock recounted summer and early fall negotiations in 2024 between the Stars, Mavericks and City of Dallas \u2014 with the latter two believing all sides agreed to a $300 million refurbishing of American Airlines Center, at no cost to the Stars.<\/p>\n<p class=\"body-text-paragraph\">The Mavericks and Dallas officials also believed the Stars had agreed to remain in AAC through 2061, with the NBA team building a new arena in time for the 2031-32 season. In an October 2025 interview with The News, Alberts strongly denied a deal had been reached. The Stars now are negotiating with Plano for a potential move there.<\/p>\n<p class=\"body-text-paragraph\">The second triggering event, Babcock said \u2014 \u201cthe straw that sort of broke our back\u201d was in October of last year, when the Stars refused to fund bonuses of Center Operating Company executives. This structure is magnificent. It is absolutely magnificent.\u201d<\/p>\n<p class=\"body-text-paragraph\">Whitehill interrupted the paused silence: \u201cKeep going.\u201d<\/p>\n<p class=\"body-text-paragraph\">\u201cThe situation we find ourselves in is because of this impasse between our ownership of the operating company and the Stars claiming ownership of it.<\/p>\n<p class=\"body-text-paragraph\">\u201cIt [AAC] is not being maintained. It\u2019s not being improved. It has problems that any building this age will start to encounter that are not being addressed. And so who is DSG?
