COLUMBIA, S.C. (WIS) – A tattoo shop and a local couple are challenging South Carolina\u2019s tattoo laws in a lawsuit, arguing the state\u2019s restrictions are outdated and improperly limit protected artistic expression under the First Amendment.<\/p>\n
The suit, filed by Tiny Zaps and two South Carolina residents, contends the state treats tattoos as \u201cdisfavored speech\u201d rather than art and expression entitled to constitutional protection. The plaintiffs argue that the law imposes broad limits on where tattoo businesses may operate and on which parts of the body adults may choose to tattoo \u2014 restrictions they say are not tied to public health or safety.<\/p>\n
South Carolina law prohibits tattoo shops from operating within 1,000 feet of a church, school or playground. It also makes it a misdemeanor to tattoo a person\u2019s head, face or neck.<\/p>\n
Tiny Zaps says it is seeking to expand into Charleston through a partnership with a boutique hotel in the city\u2019s historic district. According to the complaint, the shop has negotiated a draft agreement with the hotel operator, identified a licensed South Carolina tattoo artist to run the location, and is prepared to begin serving customers. The plaintiffs argue state law is preventing that expansion.<\/p>\n
The lawsuit contends the state already regulates tattooing through licensing requirements, mandatory safety training, sterilization standards and age restrictions, making additional location and body-placement rules unnecessary. The plaintiffs argue that the restrictions block businesses from opening in dense areas such as downtown Charleston and limit consenting adults\u2019 ability to express themselves through body art.<\/p>\n
The suit asks the court to strike down the challenged provisions, arguing they unconstitutionally restrict expression while doing little to advance legitimate safety concerns.<\/p>\n
